TUPE call for evidence
The government is seeking views on the effectiveness of the TUPE regulations as they currently stand so that it can consider how they might be improved.
Not all the government’s planned workplace reforms are contained in the Employment Rights Act 2025. Its wider aims are set out in Next Steps to Make Work Pay.
The stated aims of the call for evidence (which closes on 1 July 2026) are to help the government:
- update its understanding of the prevalence of TUPE transfers
- understand experiences with current TUPE processes
- consider how better to ensure TUPE is easy to follow for businesses
- consider how to strengthen the existing set of rights and protections for those subject to TUPE to create a more stable workforce during transitions, and
- develop policy proposals for reform
The call for evidence looks at most aspects of TUPE, including:
- the adequacy of existing protections, including consultation, collective agreements and pensions
- whether it is sufficiently clear when there is a ‘relevant transfer’ and TUPE applies
- the TUPE process, including information and consultation
- the adequacy of the guidance and support currently available
- whether the regulations governing when an employer may vary contractual terms and conditions strike the right balance, are appropriate and are sufficiently clear and specific
- the cost and impact on businesses, and
- unintended consequences, including equality impacts
