Unite hails 'landmark' overtime tribunal win

The UK’s largest union, Unite, has called a recent tribunal ruling in favour of refuse workers whose holiday pay did not include overtime a ‘landmark’ decision.

Unite brought the case against Veolia on behalf of refuse workers whose holiday pay did not reflect the voluntary overtime they worked. The employer reportedly argued that ‘Brexit legal uncertainty’ was the reason for not doing so, although it did not advance legal arguments to back this up. The tribunal judge reportedly held that the voluntary overtime was part of the union members’ normal pay because there was an intrinsic link between it and their role and because it was carried out with sufficient regularity.
