It is against the law for employers to discriminate against employees with specific protected characteristics: sex, race, disability, religion/belief, sexual orientation, age, maternity and pregnancy, gender reassignment and marriage/civil partnership. This applies even before an offer of a job is made.
Discrimination is a complex area of the law and includes both direct and indirect discrimination, harassment, victimisation and aiding and inducing others to carry out discrimination. We have significant experience in this area of the law.
Unlike unfair/constructive dismissal, there is no qualifying period of employment and no cap on compensation, and there are additional awards that can be made such as injury to feelings and personal injury. Claims can also be made whilst an employee is still employed.
